随着网络技术的飞速发展，网络环境下著作权的保护问题也日益突出，特别是在网络环境下作品的著作权人如何确定；著作权人的权利与公众的利益如何平衡；网络服务提供者应当承担怎样的责任等问题需要深入研究和探讨。本文结合互联网和网络环境下的著作权的诸多特征，对网络环境下出现的著作权主体的确认；著作权主、被动保护方式等新问题进行了思考和分析，对著作权的侵权法律责任以及网络服务提供者的法责任等问题进行了归纳和总结。【英文摘要】With the rapid development of Internet Technology, the protection issues of internet copyright are prominent with each passing day. Specially, how to identify the owner of internet copyright; how to balance the right of copyright owner and public benefit; how the internet service provider affords the responsibility, all these questions need the deeply research and approach a subject. The academic thesis combines many characteristics of internet and internet copyright, considers and analyzes the new problems like as how to identify the owner of internet copyright, the positive and passive ways of protecting the copyright; sums up and concludes the issues of infringement liabilities and legal liabilities of internet service provider. Article one of the thesis combines the characteristics of internet no national boundaries, non-focus management, spread boundless and uncontrollable, formulates the connotation of internet copyright; generalizes the influence of internet technology to tradition copyright. Article two tries to make a conclusion and suggestion that how to identify the writer under the internet, based on the fact of unable to effective identify the subject of internet copyright, references relevant case law and opinions. Article three and four, according to the different protecting ways and legal results, the protecting ways should be separated to positive protection and passive protection. I make a listing introduction for the two protecting ways, and analyze and generalize the legal issues exist. The thesis analyzes the identification of copyright owner, copyright positive protection and so on, contributes to solve the problems of unidentified the copyright owner and improper copyright protection method, and there is certain inspiration for exploring copyright issues under internet.【关键词】互联网；著作权；著作权主体；主动保护；被动保护；法律责任【英文关键词】
